Definitions
User: Any person natural or juristic who makes use of this website
IFS: MPM Accounting solutions t/a Integrated financial solutions cc duly
incorporated in the Republic of South Africa CK2002/089299/23
Whilst IFS agrees to carry out its obligation as requested by the client the
following provisos are accepted by the any user of this website
1 The User shall be obliged to deliver all relevant documentation, to the
offices of IFS required for the successful completion of the services contracted
herein.
2 While IFS undertakes to exercise due care in providing the services detailed
overleaf, the parties agree that the client shall have no claim whatsoever
against IFS for lateness, inaccuracy, error or loss of documents through fire
theft or any other cause whatsoever or consequential damages which may result.
The Client hereby indemnifies IFS, its owners, members, partners, employees and
agents against any such claims.
3.Where Integrated Financial Solutions are dependent on third parties including
but not exclusive to the South African Revenue Services. The Registrar of
companies and their associates, The labour department or any other body. IFS and
its staff shall not make any claims as to the outcome of any interaction between
ourselves and those bodies. Any such claims are only an expression of our
opinion and should be accepted as such.
4 Should the client fail to pay any monies which are due and payable in terms of
services rendered and which amount will remain unpaid for 10 days, interest will
be charged at 10% per annum. Should any amount be due and remain outstanding for
a period of 60 (sixty) days from due date, then IFS will be entitled but not
obliged to cancel this agreement forthwith without prejudice to its claim for
any amount due in terms of this agreement, or any damages which it may suffer by
reason of any such breach and / or cancellation or to any remedy which it may
have against the client.
5 Should Integrated Solutions exercise its rights against the client in respect
of the clients obligations hereunder, or to collect any overdue balances, the
client will be liable for all expenses incurred, including all legal and tracing
charges on a client to client scale.
6 The client consents and submits to the jurisdiction of the Magistrates court
in respect of any legal proceedings against the client notwithstanding that the
amount claimed by IFS might otherwise exceed the jurisdiction of that court.
7 A certificate signed by a manager of IFS (whose appointment need not to be
approved) as to the amount of the clients indebtedness to IFS, shall be
sufficient evidence for all purposes including that of obtaining judgement in
whatever form against the client.
8 IFS reserves the right to cede all its rights of this agreement to whomever it
deems fit to perform its obligations in terms of this agreement without prior
permission or advice to the client.
9 The client shall advise IFS immediately of any changes in the client’s address
and contact details. The clients Domicillium Citandi ET Executandi will be taken
as the last supplied to IFS in writing by the client. Any notice sent to the
client shall be deemed to have been received by the client on the seventh day
after posting.
10 This agreement may be cancelled in writing at any time, however the client
will be liable for the balance of the amounts due in terms of this agreement.
11.Should any queries arise from any third party including the South African
Revenue Services. The Registrar of companies and their associates or any other
authority regarding supporting documentation, the onus is on the client to
furnish proof of such documentation.
12.The Client confirms that he has the capacity and authority to enter into this
agreement.
13 Updating this statement
IFS may update these terms and conditions by posting a new version on this
website.
